В статье представлен анализ деятельности Европейского союза в области безопасности и обороны. На протяжении более 30 лет в рамках ЕС ре­ализуется общая внешняя политика и политика безопасности (ОВППБ). При этом межправительственный характер указанного сотрудничества, а также нежелание государств-членов терять контроль над сферой безопасности и обо­роны во многом сдерживал развитие данной политики. После начала специ­альной военной операции основное внимание в рамках военного измерения ЕС было сосредоточено на развитие военно-промышленного комплекса государств- членов. Для достижения поставленной цели стали использоваться традици­онные правовые инструменты в рамках внутреннего рынка и экономической политики. Это позволило избежать тех ограничений, которые предусмотрены для ОВППБ. Иными словами, полномочия ЕС в промышленной и экономической политике открыли для ЕС новые возможности играть более значимую роль в военной сфере.</p></sec><sec><title>Материалы и методы</title><p>Материалы и методы. В качестве методологической основы исследования выступили традиционные общенаучные и специальные методы познания право­вых явлений: сравнительно-правовой метод; метод научного анализа; формаль­но-юридический метод; метод синтеза социально-правовых явлений.</p></sec><sec><title>Результаты исследования</title><p>Результаты исследования. В результате проведенного исследования ав­тор пришел к выводу о том, что деятельность политических институтов ЕС в военной сфере перестают играть исключительно координирующий харак­тер. За достаточно короткий срок был принят целый пакет законодательных актов, устанавливающих новые правила в бюджетной, промышленной и иных сферах, которые приводят к формированию общей военно-промышленной политики на уровне всего Союза и усилению роли Европейской комиссии в этой сфере.</p></sec><sec><title>Обсуждение и заключение</title><p>Обсуждение и заключение. Создание общих механизмов закупки вооруже­ний, регулирования военно-промышленного комплекса и привлечения инвести­ций может привести к нарушению самостоятельности государств-членов в сфере обороны и безопасности. Фактически политика ЕС в военной сфере должна привести к формированию Европейского рынка обороны, благодаря ко­торому Союз получит возможность существенно усилить свою роль в указан­ной сфере без создания полноценного военного союза. Исследование показывает,</p></sec></abstract><trans-abstract xml:lang="en"><sec><title>Introduction</title><p>Introduction. This article presents an analy­sis of the European Union's activities in the field of security and defense. For over 30 years, the EU has implemented a common foreign and security policy (CFSP). However, the intergovernmental nature of this cooperation, as well as the reluctance of member states to lose control over security and defense, has largely hindered the development of this policy at the EU level. Following the launch of the special military operation, the primary focus of the EU's military dimension was on the development of the military-industrial complex of member states. To achieve this goal, traditional legal instruments within the frame­work of the internal market and common economic policy were used. This made it possible to avoid the restrictions imposed by the CFSP. In other words, the EU's powers in industrial and economic policy have opened up new opportunities for the EU to play a more significant role in the military sphere.</p></sec><sec><title>Materials and methods</title><p>Materials and methods. The methodological basis of the study was traditional general scientific and specialized methods of understanding legal phe­nomena: the comparative legal method; the method of scientific analysis; the formal legal method; A method for synthesizing socio-legal phenomena.</p></sec><sec><title>Research results</title><p>Research results. The author concluded that the activities of EU political institutions in the military sphere are no longer solely coordinating in its nature. In a relatively short period of time, EU institutions have adopted a package of legislation establishing new rules in budgetary, industrial, and other areas, leading to the creation of the common military-indus­trial policy on the EU level and a strengthening of the Commission's role in this area.</p><p>Discussion and conclusion. The creation of common mechanisms for arms procurement, regula­tion of the military-industrial complex, and invest­ment could undermine the independence of Member States in defense and security. In fact, EU military policy should lead to the formation of a European defense market, which would enable the Union to significantly strengthen its role in this area without creating a full-fledged military alliance. The study shows that the provisions of the EU Treaty regard­ing common foreign and security policy are not the only legal basis for the development of the Union's military dimension.
